Terms of Use

These terms govern use of the Sessionly platform — the Sessionly iOS app, the Practice Portal, and related services (the "Service") — operated by Sessionly Ltd, a company registered in England and Wales (company number 17156289). By creating an account or using the Service, you agree to these terms.

1. The Service and the pilot

Sessionly is a booking platform that connects GP locums with GP practices, and provides supporting tools such as compliance tracking, messaging, NHS Pension form preparation and invoicing.

The Service is currently provided as a pilot: it is under active development, provided free of charge during the pilot period, and features may be added, changed or withdrawn. We will give reasonable notice of significant changes, including any move to paid plans after the pilot.

2. Accounts and eligibility

• Locum users must be GMC-registered general practitioners (or eligible to work as GP locums in the UK) and at least 18 years old.
• Practice users must be authorised to act on behalf of their GP practice.
• You are responsible for keeping your login credentials secure and for activity on your account. Information you provide must be accurate and kept up to date.

3. Verification and compliance

Locums may upload compliance documents for verification. Verification status shown on the platform reflects our review of the documents provided; it does not replace a practice's own legal obligations to carry out employment checks. Practices remain responsible for satisfying themselves that any locum they engage meets the requirements applicable to their engagement.

4. Bookings

• Sessionly facilitates the arrangement of shifts between practices and locums. The engagement for any shift is between the practice and the locum directly. Sessionly is not a party to that engagement, is not an employment agency or employer of locums, and does not set or guarantee rates.
• Practices are responsible for the accuracy of shifts they post; locums are responsible for honouring bookings they accept. Cancellations should be made through the platform as early as possible.
• Payment for shifts is made directly between the practice and the locum. Where the Service generates invoices or timesheets, these are prepared from the shift data on the platform and the details provided by the locum; both parties should check them before relying on them.

5. Pension forms and documents

The Service can prepare NHS Pension forms (such as Locum A and B) and other documents from platform data. These are provided as a convenience: you are responsible for checking their accuracy and for submitting them to the relevant bodies within applicable deadlines. Sessionly does not submit forms to NHS Pensions on your behalf.

6. Acceptable use

You agree not to: misuse the Service or interfere with its operation; upload unlawful, misleading or infringing content; misrepresent your identity, qualifications or verification status; use the platform to circumvent verification or safety features; or attempt to access data or accounts that are not yours.

We may suspend or remove accounts that breach these terms or present a risk to other users.

7. Messaging and conduct

Messaging is provided for arranging and managing shifts. Be professional; do not send abusive, discriminatory or unlawful content. Do not share other users' personal data outside the platform except as needed to fulfil a booking.

8. Intellectual property

The Service, including its software, branding and content (excluding content you upload), belongs to Sessionly Ltd or its licensors. You may use the Service only as permitted by these terms. You retain rights in the documents and content you upload, and grant us a licence to store and process them to provide the Service.

9. Availability and liability

• The Service is provided on an "as is" basis during the pilot. We do not guarantee that the Service will be uninterrupted or error-free, that shifts will be filled, or that locums or shifts will be available.
• Nothing in these terms limits liability that cannot be limited by law. Subject to that, Sessionly is not liable for: loss of profits or business; the acts or omissions of practices or locums (including non-payment, cancellation, or the conduct of an engagement); or losses arising from inaccurate information provided by users. During the free pilot, our total liability to you is limited to £100.
• Nothing in these terms affects a patient-facing clinical relationship; Sessionly is a workforce booking tool and provides no clinical advice.

10. Data protection

Our handling of personal data is described in our Privacy Policy (sessionlygp.co.uk/privacy), which forms part of these terms.

11. Ending your use

You can stop using the Service and ask us to close your account at any time. We may suspend or terminate accounts for breach of these terms, misuse, or if the pilot ends. Sections that by their nature should survive (including liability and intellectual property) survive termination.

12. Changes to these terms

We may update these terms as the Service develops. We will post the updated terms with a new date and, for significant changes, notify you in the app or by email. Continued use after changes take effect constitutes acceptance.

13. General

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If any provision is found unenforceable, the rest remain in effect.
